Vehicle Delivery/Pickup Authorization
Authorization terms for limited concierge delivery or pickup services requested through Drive Oz.
Purpose and scope of authorization
This Vehicle Delivery/Pickup Authorization is entered into by and between the customer and Drive Oz Motors, Inc., a Florida corporation, with a principal business address of 3749 N Federal Hwy, Pompano Beach, FL 33064.
At the customer request, Drive Oz may provide a limited concierge delivery service whereby a licensed Drive Oz employee or authorized agent operates the vehicle solely for delivery from a selling dealer to the customer designated address or from the customer designated location to a third-party dealer, wholesaler, auction, or buyer.
Customer ownership, registration, and authority
The customer represents and warrants that the customer is the legal owner of the vehicle or is authorized to act on behalf of the business entity that owns the vehicle, and that the vehicle is properly titled, registered, and insured.
No ownership, bailment, or agency
Drive Oz does not take ownership of the vehicle and does not act as a motor vehicle dealer, broker, transporter, carrier, insurer, or fiduciary. Any operation of the vehicle is temporary, limited, and solely for customer convenience.
Insurance, assumption of risk, and release
The vehicle owner insurance policy is primary for any loss, damage, liability, claim, or expense arising out of or relating to operation of the vehicle during delivery or pickup.
To the maximum extent permitted by law, the customer assumes risks associated with delivery and operation of the vehicle and releases Drive Oz Motors, Inc. and its officers, directors, employees, agents, and contractors from claims arising out of or relating to delivery or operation, except to the extent caused by gross negligence or intentional misconduct.
Dispute resolution and electronic execution
Any dispute arising out of or relating to the authorization, delivery, or operation of the vehicle by Drive Oz personnel shall be resolved exclusively by final and binding arbitration in Broward County, Florida.
This authorization may be executed electronically, and an electronic signature has the same legal effect as a handwritten signature.
